1. Acceptance of These Terms

These Terms of Use form an agreement between you and VelvetPix governing your use of the VelvetPix Android application, related services, and these web pages. By downloading, accessing, or using VelvetPix, you agree to these Terms and the applicable Google Play terms. If you do not agree, do not use VelvetPix.

2. Eligibility

VelvetPix is intended only for individuals who are at least 18 years old. By using VelvetPix, you confirm that you are 18 or older and legally able to enter into this agreement.

3. Limited License

VelvetPix grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the application on compatible Android devices for lawful, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, bypass security controls, or commercially exploit VelvetPix except where applicable law expressly permits it.

4. Acceptable Use

You agree not to use VelvetPix to violate law, infringe intellectual property or privacy rights, distribute malicious material, interfere with the service, attempt unauthorized access, or submit content you do not have the right to use.

5. Gold Coins and Purchases

VelvetPix may offer gold coins and membership through Google Play. The price, quantity, billing period, and confirmation details shown by Google Play at purchase control the transaction. Gold coins are digital app functionality, have no cash value, are not legal tender, and cannot be transferred outside VelvetPix.

Unless required by law or Google Play policy, completed purchases are handled under Google Play's refund rules. Membership purchases are also governed by the Membership Agreement.

6. Your Local Content

You retain responsibility for the images, titles, notes, and other content you choose to place in VelvetPix. You confirm that you have the necessary rights to use that content. Most archive content is stored on your Android device; deleting the app, clearing storage, resetting data, or losing the device may permanently remove it.

7. AI-Assisted Features

AI-generated identification and guidance may be incomplete or inaccurate. Results are provided for personal informational use and should be reviewed before being saved or relied upon. Do not submit confidential, unlawful, or rights-infringing material. VelvetPix does not guarantee that an image will be identified or that an answer will be correct.

8. Updates and Availability

We may update, improve, suspend, or discontinue features to maintain security, comply with law, or improve VelvetPix. A compatible device, current Android software, and network connection may be required for certain features. We do not guarantee uninterrupted availability.

9. Intellectual Property

VelvetPix, its visual design, software, branding, and original materials are protected by applicable intellectual property laws. These Terms do not transfer ownership of VelvetPix or third-party materials to you.

10. Disclaimer

To the maximum extent permitted by law, VelvetPix is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Nothing in these Terms excludes rights that cannot lawfully be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, VelvetPix will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of access, or loss arising from reliance on AI output. Any liability that cannot be excluded will be limited to the amount you paid for VelvetPix during the twelve months before the event giving rise to the claim, unless applicable law requires otherwise.

12. Changes and Termination

We may revise these Terms. Continued use after updated Terms become effective indicates acceptance where permitted by law. You may stop using VelvetPix at any time. We may restrict access if use materially violates these Terms, law, security requirements, or the rights of others.
